Hr Mandi Bhav - (property rights of wife)  Husband and wife have all rights on each other. Similarly, they have equal rights on all their things. But here the question also arises whether the wife has a right on the husband's property. 

Is she equally entitled to it? In response to all these questions, recently the High Court (Madras High Court decision) has given a big decision. 

For your information, let us tell you that the Madras High Court recently gave a decision, in which it is said that a wife manages the house, sacrifices her dreams to enable her husband to go out for work and earn and contributes equally to the earning of family property. 

Therefore, she is entitled to half of all the properties purchased by the husband in his name. This special comment has been made on this by the court (high court decision). 

In his judgment on this property case, Justice Krishnan Ramasamy (High Court Justice) said, "Although no law has been made in India so far to recognize the contribution made by the wife directly or indirectly, the court can well recognize such contribution."

The court said this

On this matter, the High Court said, "It is a difficult task to take care of her husband and children, as a result of which in the end she is left with nothing that she can call her own." 

The court said that therefore, if the acquisition of property is done for the welfare of the family directly or indirectly with the joint contribution of both the husband and wife, then both will be entitled to an equal share. The court has called both of them equally entitled. 

What is the matter

If we talk about this whole case, the High Court was hearing a dispute between a couple married in 1965. For information, let us tell you that in 2002, husband Kannaiyan Naidu filed a case stating that while he worked abroad, his wife tried to take possession of the properties purchased by him with his money. Naidu also alleged that his wife was taking the help of a person to transfer the properties to her name and was living a wrong life.

Wife gave this answer

On this, the wife says that she is entitled to the property rights because she took care of the family while her husband was abroad and hence she gave up her employment opportunities. 

She further said that she sold her ancestral property for her husband. She further said that she bought the properties by saving money from tailoring and tuition.
