Supreme Court: Every day new cases of divorce keep coming up, the court has given an important decision regarding the right of children to get property after the divorce of the wife. Under which it is said that a man can divorce his wife, but it is also said that divorce cannot happen with children.

HR Mandi Bhav News, Digital Desk - In an important decision , the Supreme Court gave a man the freedom to divorce his wife , but also said that divorce cannot take place with children.
The apex court has given six weeks' time to this Mumbai-based man involved in gem and jewelery business to deposit the settlement amount of Rs 4 crore.
The apex court also approved the divorce by mutual consent of the couple, who were living separately since 2019, using its overall powers under Article 142 of the Constitution.
Earlier, during the hearing before the bench of Justice DY Chandrachud and Justice MR Shah, the husband's lawyer asked for some more time to pay the settlement amount citing loss in business due to the Corona epidemic.
But the bench said, you yourself have agreed in the agreement that you will pay Rs 4 crore on the day of divorce decree. Now it would not be correct to argue that this is a financial constraint. The agreement was signed in 2019 and there was no pandemic at that time.
The bench said, you can divorce your wife. But you cannot divorce your children, because you have given birth to them. You have to take care of them. You will have to give the settlement amount to your wife so that she can support herself and the minor children.
Along with this, the bench ordered the husband to pay Rs 1 crore by September 1 and the remaining Rs 3 crore before September 30.
The bench ended the legal processes on both sides-
All legal proceedings initiated by the couple against each other and their relatives were also ended. The bench said that all other terms of the agreement between the separating couple will be fulfilled as per the contract between them.
The bench noted that the estranged couple had a son and a daughter and the terms of their custody had already been agreed upon by both the parents.
